पछिल्लो समय गैरआवासीय नेपाली संघ (एनआरएनए) र गैरआवासीय नेपाली (एनआरएन) हरुमा नेपाली कांग्रेस र नेकपा एमालेको गिद्दे पन्जाले जकड्याएको छ। यसैका कारण संघको बिभाजन र अन्त्य भएको छ।
नोट: यसलाई बुझ्न अन्तिमको “मुख्य प्रश्न र जवाफ” हेर्नुहोला।
बिनोद कुँवर पक्षले अदालतमा दिएको निवेदनमा न्यायमूर्ति सपना मल्ल प्रधानको नेतृत्वको डिभिजन बेञ्चको फैसला निवेदनमा मागिएको भन्दा बाहिर गएर आयो। त्यसलाई पनि मानियो तर सोहि बिषयमा, सोहि विवादमा एमाले पक्षको निवेदनको अर्को डिभिजन बेञ्चको फैसला सुनियोजित नै देखियो। त्यसैले यसको कारणको खोजी सर्वोच्च अदालतका सम्माननीय प्रधानन्यायधिसज्यूबाट हुनुपर्छ।
सो मुद्धामा संबन्धित न्यायमुर्ती र मुद्दाबीचको संबन्ध खोजियोस। यदि कोहि कसैको धर्मपुत्र हो भने उसले धर्मपिताको विपक्षमा गएको इतिहास कम नै छ। न्यायमुती र एमाले अध्यक्ष केपीशर्मा ओलीबिचको संबन्ध अनि डा. बद्रि केसी र एमालेबिचको बिचको संबन्ध, मुख्य/महान्यायधिवक्ता र एमाले अध्यक्ष केपीशर्मा ओलीबिचको संबन्ध पनि खोजियोस।
यदि निवेदकका कानुनी प्रतिनिधि नै महान्यायधिबक्ता अघिल्लो मुद्धामा थिए भने नियमापती न्याय मुर्तीले गर्नुपर्नेथियो, त्यसो किन भएन। कुनै पनि निवेदनमा महान्यायधिबक्ताको बहस भनेको न्याय र कानुनको पक्षमा हुनुपर्छ तर त्यसो भएन। त्यसैले भनिएको अदालतको दोश्रो फैसला न्यायिक नभएर राजनैतिक दलको निर्देशन जस्तोभयो। यो फैसलाको बिरुद्ध प्यानल या फुल कोर्टमा जाने बाटो भएकाले फैसला चित्त नबुझे विपक्षमा बोल्न, लेख्न र अर्को निवेदन दिन पाइन्छ।
प्रश्न र कारक तत्व
१. एउटै बिषयमा २ न्यायाधिसको (डिभिजन) बेञ्चले गरेको फैसला अर्को २ जना न्यायधिसको (डिभिजन) बेञ्चले फरक रुपमा फैसला गर्न मिल्दैन, हुँदैन र सक्दैन। कि पहिलो फैसलाको सदर गर्नुपर्छ कि प्यानल बेञ्च या फुल कोर्टमा पठाउनुपर्थ्यो। त्यसो भएन, किन ? मुख्य बेथा, नियत, कारण र समस्या नै यहि हो।
२. संस्थाको १० औं महाधिवेशन नै दोहोर्याएर गर्नुपर्ने फैसला हुँदा-हुँदै ११ औं महाधिवेशन कसरी आधिकारिक हुन सक्छ? यो त सामान्य न्यायिक कुरा हो, सर्वोच्चका न्यायमुर्तीबाट कसरी गल्ति हुन सक्छ ? अर्को मुद्धा पाटन उच्च अदालतमा हुँदा-हुँदै त्यसको मिसिल किन तानिएन ? गरिएको फैसलामा ठुलो लुपहोला छ। यहाँ त्यसैको प्रयोग गर्नसकिन्छ, अब गरिने १० औं महाधिवेशन मात्रै आधिकारिक हुने ठाउँ छ। यसको नतिजा संस्था अदालतको दोश्रो फैसलाले आधिकारिक रुपमा बिभाजित र अन्त भएको अवस्थामा लगिदियो।
३. यो सबै हुनमा नेपाली कांग्रेसका गगन थापा र पुर्ण बहादुर खड्का जिम्मेवार छन्। त्यसैगरी नेकपा एमालेका अध्यक्ष केपीशर्मा ओली, महेश बस्नेतको गुण्डागर्दी र लुटेरो नियत पूर्ण रुपमा जिम्मेवार छ।
४. अब यो सबैको आधिकारिक र कानुनी जिम्मेवारी चाहिं पूर्व परराष्ट्रमन्त्रीहरु विमला राइ पौडेल, एनपी साउद, नारायणकाजी श्रेष्ठ र वर्तमान परराष्ट्रमन्त्री डा. आरजु राणा-देउबाले लिनुपर्छ। पूर्व परराष्ट्रमन्त्री डा. नारायण खड्काको प्रयास सहि थियो, उनि दोषी देखिंदैनन।
राष्ट्रपतिका कुरा
पूर्व राष्ट्रपति बिद्यादेवी भण्डारीले राय सल्लाह नलिएर बैध रुपमा होटल एक एण्ड यतिमा आयोजित १० औं महाधिवेशनमा नगएर अबैध रुपमा हिमालय होटलमा आयोजित भेलामा जानु गलत थियो। वर्तमान राष्ट्रपति रामचन्द्र पौडेलबाट पनि यस्तै बिभेदकारी भूमिका देखिएको छ। राष्ट्रपति जस्तो सम्मानित संस्थाले यसो नगर्नुपर्ने हो। उपरान्त राष्ट्रपतिबाट कानुनी र आवश्यक राजनैतिक सल्लाह नलीइकन यस्ता विवादित गतिबिधिमा सहभागिता नगरियोस।
मुख्य प्रश्न र जवाफ
१. अदालतको पहिलो फैसलाको पूर्णप्रति अनुसार संघको १० औं महाधिवेशनको काम गर्न भनेर नेपाल सरकारको परराष्ट्रमन्त्रालयले यो लेख्दाको मिति र समय सम्म पनि पूर्व अध्यक्ष डा. शेष घलेलाइ पत्र दिएको छैन। पत्र नै नभएको बेला काम कसरी गर्ने ? पत्र आएपछि के गर्ने त्यो कुरा डा. घलेमा निर्भर हुने कुरा हो।
२. संघको १० औं महाधिवेशनको तयारी नै सुरु भएको छैन भने ११ औं महाधिवेशन कसरी आधिकारी हो ? त्यो भन्दा पछाडीको फैसलाको पत्र नै नपाइकन डा. बद्रि केसीहरुलाइ के को हतारो? भोलिको १० औं महाधिवेशनले सबै बदर गर्दा अहिले सम्मको सबै क्षतिपूर्ति दिने हिम्मत छ ? होसियार !
३. भनिएको आरके शर्माको अर्को निवेदनमा ११ औं महाधिवेशनको आधिकारिकता मागीएकाले १० औं महाधिवेशन नभएको अवस्थामा त्यसको कुनै अर्थ र औचित्य नै छैन। उनले संघको १० महाधिवेशन फेरी गर्नुपर्ने फैसला आएकाले त्यसपछिको अर्को फैसला अन्यथा आएकाले त्यो दोश्रो फैसला बदर हुनुपर्छ भनेर निवेदन गर्नुपर्ने थियो।
अन्तमा;
यो सबै हुनमा नेपाली कांग्रस र नेकपा एमालेको गिद्दे दृष्टि आम गैरआवासीय नेपाली र उनीहरुको संस्थामा परेको छ। यसको निराकरण अरुबाट संभव छैन। संघ अन्त्यको बाटोमा गएकै हो। अब संघको चल-अचल सम्पती र जे जति छ त्यो सबै संघ दर्ताको बिधि-बिधान अनुसार नेपाल सरकार परराष्ट्र मन्त्रालयको हुन्छ। उसले बुझिलिन ढिलो गर्नुहुँदैन।
उपरान्त, आम एनआरएनहरुले कांगेस र एमाले दुवै पार्टी नै मुख्य दुश्मन भएकाले उनीहरुलाइ असहयोग, बिरोध र विपक्षमा जानुको विकल्प छैन। जुन राजनैतिक दलले हाम्रा एजेन्डा र सपोर्ट गर्छ उनीहरुलाइ मात्र सपोर्ट गरौँ।
