१. पहिलो कुरा, वर्तमान संबिधान अनुसार संसदमा स्पष्ट बहुमत ल्याउने दलको संसदीय दलनेता बिनासर्त प्रधानमन्त्री हुने हो। अहिलेको संसदमा कसैको पनि स्पष्ट बहुमत नभएकाले त्यो संभव छैन।
२. दोश्रो, पहिलो ब्यबस्था संभव नभएपछि सबै भन्दा ठुलो दलको नेताको नेतृत्वमा सरकार बन्ने हो। त्यसको सर्त चाहिं ३० दिन भित्रमा संसदमा बहुमत प्रमाणित गर्नुपर्ने हो। जुन प्रयास गरिएन या भएन भनौ। यस्तो अवस्था आएको भए त्यसलाई गठबन्धन भनिन्थ्यो तर प्रधानमन्त्री चाहिं सबै भन्दा ठुलो दलका दलनेता नै हुन्छन। अन्य दलले हुन पाउँदैन या स्वभाविक होइन।
३. तेश्रो चाहिं माथिका दुवै कुरा नभएमा कुनै पनि एकल सांसदले संसदमा निर्वाचन मार्फत बहुमत लिएर अनि मात्र प्रधानमन्त्रीको दावी गर्न राष्ट्रपतिकोमा जानुपर्ने हो। त्यसो कहिलै पनि गरिएन या भनौं गरिंदैन। किन की यो भनेको एकल सांसदको प्रयास हो। दलहरुको समर्थनको चिठी लिएर गइन्छ। उदाहरणको लागि अगाडीका प्रधानमन्त्री पुष्पकमल दाहालले पहिला संसदमा बहुमत लिएर अनि मात्र प्रधानमन्त्रीको दावी गर्नुपर्ने थियो। त्यो भएन। यसरी बनेका एकल सांसद सदस्यको समर्थन प्राप्त प्रधानमन्त्रीलाइ समर्थन दिन्न भनेर अन्य सांसदले अविश्वासको जानकारी सभामुख समक्ष लिखित रुपमा दिएमा। विश्वको मत बहुमत रहेको सम्म सभामुखले चुप बस्छन। तर बहुमत नपुगेको अवस्थामा या बहुमत नरहेको प्रष्ट नभएको अवसथामा मात्र विश्वस छ या छैन भनेर संसदमा निर्वाचन गराउने हो। यो स्थितिमा दलहरुको व्हिपर दलीय समर्थनको अर्थ रहंदैन। सबै सांसदहरुलाइ एस, नो र न्यूट्रल मत दिने अधिकार हुन्छ। मत नापुगेक्मा सरकार खाली हुन्छ। ३० दिन कुरेर विश्वासको मत लिनुपर्दैन। तेश्रो विकल्पमा बनेको सरकारमा सबै भन्दा ठुलो दल अनिबार्य रुपमा प्रतिपक्षमा बस्नुपर्छ। किनकी उसले दोश्रो विकल्प गुमायो, फेलभयो। यो ठ्याक्कै राष्ट्रिय सरकार होइन तर एक हदसम्म समान हो। राष्ट्रिय सरकारमा एउटा मात्र सर्त हुन्छ आगामी निर्वाचन अन्य सर्त हुँदैन। बनेपछि विश्वासको मत फेरी लिनु पर्दैन।
४. उपरोक्त तिनै बिधि पुरा भएपछि उही संसदले उही संबिधान कायम रहेको अवस्थामा संबिधानको विकल्प तीनमा फेरी फर्कन् मिल्दैन। चौथो विकल्पमा जानुपर्छ। एउटा बिधि फेल भएपछि त्यसैमा फर्कन मिल्दैन। अर्थात अहिलेका केपी ओली प्रधानमन्त्री बन्न मिल्दैननथियो। यो संसदीय प्रक्रियाको बिधि मिचेर गरिएको अबैध सरकार हो।
५. उपरोक्त दोश्रो बिधि फेल भएर तेश्रो अवस्था आउँदा सबै भन्दा ठुलो दल विपक्षमा बस्नुपर्छ। अर्थात त्यो भनेको प्रतिपक्षहरुको मौका हो। अघिल्लो समय पुष्पकमल दाहाल प्रधानमन्त्री हुँदा नेपाली कांग्रेस प्रतिपक्षमा हुनुपर्नेथियो।
६. अब तेश्रो विकल्पमा प्रधानमन्त्रीबाट अल्पमतमा परेका पुष्पकमल दाहालपछि संसदले फेरी तेश्रो विकल्पमा नै सरकार बनाउन जान मिल्दैनथियो। आर्थात एक-दुइ-तीन हुँदै चारमा जानुपर्छ। एक-दुइ-तीन फेरी तीन होइन। त्यसपछि चारमा जानुपर्छ, तीनमा फर्कन पाइंदैन, मिल्दैन।
७. अब चौथो विकल्प भनेको राष्ट्रपतिले ठुलो दलका नेता अर्थात अहिलेको संसदमा नेपाली कांग्रेसका नेता शेरबहादुर देउबा (अन्यथा संसदीय दलनेता फेरिएन भने) लाई यो वर्तमान संसदको निर्विकल्प र अन्तिम प्रधानमन्त्रीको रुपमा ६ महिनाभित्रमा निर्वाचन गर्ने सर्त सहित अल्पमतको प्रधानमन्त्री नियुक्त गर्ने हो। त्यो अवस्थामा प्रधानमन्त्रीले अल्पमतको सरकार बनाउँछ र बाँकी सबै दल प्रतिपक्ष हुन्छन। त्यसलाइ ६ महिनाको चुनाव गर्ने म्याद रहन्छ। त्यसो भएन भएको छैन।
