नेपालमा प्रजातन्त्र होइन दलहरु असफल:इण्डिकेटर सहित

सबैले भन्ने गरेको, जानेको, सुनेको र बुझेको कुरा प्रजातन्त्रको स्वच्छ मूल्याङ्कन गर्दा राजनैतिक, सामाजिक र आर्थिक जीवनका विभिन्न पक्षहरूलाई जोडेर ब्याख्या गर्नुपर्छ भन्ने हो। तर त्यो कुरा केवल सतही मात्र हो बिस्तृत होइन। तीन/तीन तहका अदालतबाट ज्यानमारा प्रमाणित भएका व्यक्तिलाइ सबै पार्टी र राष्ट्रपति सदर गरेर जेलमुक्त गरेर निर्वाचनमा उम्मेदवार बनाउने देश पनि नेपाल हो। सोझा र निमुखाहरुले दु:ख मात्र पाउने, च्यान र ज्यान बेच्ने देश पनि नेपालको सक्कली कुरुप अनुहार हो, यस्ता धेरै उदाहरण छन्। 

नेपालको पछिल्लो राज्यब्यबस्था र प्रजात्रन्त्रबारे केहि महिना देखि आफूले गरेको अध्ययनलाइ यहाँ २५ वटा मुख्य सूचकका २/२ वटा उपसूचक गरि जम्मा ५० सूचकहरूको सूची तयार पारेको छु। यी सूचकहरुमा धेरैजनासँग कुराकानी पनि गरियो। अनि त्यसैको आधारमा नेपालमा प्रजातन्त्रको वर्तमान अवस्थाको मूल्याङ्कन गर्ने प्रयास गरियो। 

यो पटक विशेष गरी राजनैतिक दलहरूको कार्यशैलीमा ध्यान केन्द्रित दिनु जरुरी छ। प्रजातन्त्रमा सरकार चलाउने भनेको दलहरुले नै हो। त्यसैले दलहरु असफल भए भने प्रजातन्त्रमा पनि असफल हुन् आउँछ। पछिल्लो समय बहुदल फालेर गणतन्त्र भनियो त्यो समय देखि नेपालमा प्रजातन्त्र ओरालो लाग्दै गएको पाइयो।

अब कुरा गरौँ मुख्य मुद्धामा:

१. निर्वाचनमा अनियमितता र धाँधली

क. नेपालका सबैजसो निर्वाचनहरुमा मतदाता माथि जालसंझी वा अनियमितताको प्रमाण-निर्वाचनको क्रममा देखिएका छन्। निष्पक्ष निर्वाचनको विश्वसनीयताका गिर्दो रुपमा छ। दोहोरो मतदान, नक्कली मतपत्र, वा सम्झौता गरिएको मतपत्र, गठबन्धनले गरेको पार्टीमा अनिबार्य रुपमा इच्छा बिपरित गराइने मतदान र मतदान प्रणालीको प्रमाणीकरणमा संकास्पद उदाहरण पाइएका छन्।

त्यसैगरी पारदर्शी छानबिन, उम्मेदवारहरुको चुनाव आम्दानीको र श्रोतको र खर्च विवरण, लेखापरीक्षण, कानुनी प्रक्रियाहरूको गरिएको पाइएन। केवल औपचारिकता मात्र पाइयो। निर्वाचन ऐन-कानुनको पालना जस्ता बिषयहरुमा आवश्यक कदम देखिएन। मतपत्र च्यातेर भनेकैलाइ जिताउन राजनीतक गठबन्धन हुनु। निर्वाचनको नतिजा पछि एक दलले बहुमत नल्याउँदा मात्र गठबन्धनको सरकारको पहल गर्नुपर्नेमा निर्वाचन पहिला नै राजनैतिक गठबन्धन गर्नु जस्ता कुरा निर्वाचनमा भएका अनियमितता र अप्रजातान्त्रिक बिधि हुन्। 

ख. मतदाताको दर्ता प्रक्रियामा हेरफेर, निर्वाचनको लागि मतदाता दर्तालाई अनुचित प्रभाव पार्ने कार्य वा गतिविधिहरू भएका पाइयो। यस्ता हेरफेरहरूले विभिन्न रूपहरू भएका छन्। पक्षपातपूर्ण वा उम्मेदवारको योजनामा मतदाताको सहभागितालाई दबाउन वा बढाउने प्रयासहरू भएका छन्। मतदाता दर्ता प्रक्रियाको हेरफेरसँग सम्बन्धि हेर्ने प्रक्रिया धेरै पुरानो छ। यसमा सामान्य पनि परिमाजन र अध्ययन गरिएको पाइएन। 

२. राजनीतिक तनाव र हिंसा

क. राजनैतिक रूपमा प्रेरित हिंसाका घटनाहरू थुप्रै भएका छन्। 

ख. राजनीतिक रुपमा पहुँच भएका उम्मेदवार, सत्ता र शक्ति पुगेका उम्मेदवारले शक्ति बिहिन उम्मेदवारलाई बल प्रयोग गरेर दमन गर्ने काम भएका छन्।

३. वाक स्वतन्त्रता

क. पछिल्ला समय सेन्सरशिप वा अभिव्यक्ति र अभिव्यक्तिको स्वतन्त्रतामा प्रतिबन्ध लगाउने खालका घटनाहरू देखिएका छन्। त्यसमा पनि शक्ति सम्पन्नले सामान्यलाइ दबाउने देखिन्छ। 

ख. पत्रकार, संचारकर्मी विरुद्ध उत्पीडन वा हिंसा भएका छन्।

४. मिडिया कम्पनि र न्यूज एजेन्सीहरु स्वतन्त्रता र पेड मिडियाको बल

क. न्यूज या मिडियामा एकाग्र स्वामित्वको कारण पेड मिडिया रोलले आम उम्मेदवरका बिषय छायाँमा परेको पाइयो। यसबाट मिसइन्फरमेशन र डिसइन्फर्मेशन बढेको छ। मिडियाकर्मी भन्दै सामाजिक संजालकर्मी, निजी यूट्यूबरहरुले गुण्डा-गर्दी गरेर जबर्जस्ति गरेको पाइयो। संचार कि त कब्जामा छ की भने पहुँचमा छैन।

ख. सरकारी न्यूज एजेन्सीहरुमा राजनैतिक हस्तक्षेप जहिले पनि भएका छन्।

५. भ्रष्टाचार

क. राजनैतिक दलभित्र व्यापक भ्रष्टाचार र अपारदर्शीता छन्। आफ्नै दलको उम्मेदवारको टिकेट बेचेको पाइयो। ठुला दलहरुले संसदीय चुनावमा अर्बौं खर्च गर्छन तर खातामा केहि हजार या केहि लाख मात्र देखाउँछन्। उनीहरु नै भन्छन चुनाव महँगो भयो-करोडौं लाग्छ तर हिसाबमा भने एकाद लाख मात्र छ। 

ख. राजनैतिक दलहरुको वित्तिय पारदर्शिताको अभाव देखिन्छ। डोनेशन खातामा लिने जम्मा एउटा मात्र दल रहेछ। अरु सबैले व्यक्तिगत रुपमा लिने रहेछन।

६. नागरिक स्वतन्त्रता

क. शान्तिपूर्ण भेला र विरोध प्रदर्शनमा प्रतिबन्ध जस्ता घटना देखिए। दबाउने र हिँसा पनि भएका छन्। 

ख. उचित प्रक्रिया बिना नै मनमानी गिरफ्तारी वा बन्दी बनाइएका छन्। 

७. न्यायिक स्वतन्त्रता

क. न्यायपालिकामा राजनीतिक हस्तक्षेपका प्रयास भएका छन्। सरकारी वकिलहरुले दलको आदेशले मुद्धा दर्ता गर्ने या नगर्ने गर्छन।  

ख. मुद्धाको दावी प्रकृति अनुसार फैसला अहुन्छ। सरकारी वकिलहरुले कानुनको पक्षमा होइन दलको पक्षमा या सरकारको पक्षमा मात्र काम गरेको पाइयो। यसबाट निर्णय प्रक्रियामा न्यायिक स्वायत्तताको अभाव भएको देखियो।

८. अल्पसंख्यक र अशक्त अधिकार

क. अल्पसंख्यक र अशक्तहरूको अधिकारलाइ राजनैतिक रुपाम प्रतिनिधिओ रुपमा मात्र हेरियो। तर यथार्थ चाहिं उनीहरुको आर्थिक र सामाजिक उन्नतिमा हो। 

ख. राजनैतिक संस्थाहरूमा अल्पसंख्यक समूहहरूको प्रतिनिधित्वको गराइएको छ तर आर्थिक-सामाजिक रुपमा उनीहरु तल नै छन। 

९. लैङ्गिक तथा यौनिक समानता

क. राजनीतिमा लैङ्गिक र यौनिक विभेद बिषयमा धेरै कानुन तर वास्तविक रुपमा कम प्रयोग भएको देखियो। जस्तोकी टिकेट दिंदा प्रमुखमा पुरुष र उपमा महिला धेरै छन्। यो सबै जसो दलहरुले गरेका छन्।

ख. राजनीतिक पदमा महिलाको अपर्याप्त प्रतिनिधित्व देखियो। जितेकामा पनि उनका श्रीमानहरुको प्रमुख भूमिका या हस्तक्षेप धेरै भएका छन्। यसको प्रतिवाद एकाद रुपमा त निर्वाचित महिला प्रतिनितीको पारपाचुके भएको पाइयो। 

१०. आर्थिक असमानता

क. आर्थिक नीतिहरू निश्चित समूहहरूको पक्षमा छन्। आम नागरिकको लागि छैन। 

ख. असमानतालाई सम्बोधन गर्न सामाजिक कल्याणकारी कार्यक्रमहरूको भनिएको छ तर त्यसको प्रयोग दलगत स्वार्थमा भएको छ।

११. विधिको शासन

क. राजनैतिक सम्बद्धतामा र निर्वाचित व्यक्तिको जिम्मेवारी जस्ता कुराको कानून समान रुपमा छैन या बिधि अनुसार छैन। 

ख. मानव अधिकार उल्लङ्घनका लागि जवाफदेहिताको अभाव छ। ज्यानमारालाइ पनि राजनैतिक शरण दिएको र छुटाएको छ। सबैभन्दा धेरै उलंघन सरकारी पक्षबाट भएको पाइयो। 

१२. शिक्षामा पहुँच र नयाँ पन

क. सामाजिक-आर्थिक कुरामा नागरिक बिकास नहुँदा शिक्षामा समान पहुँच छैन। 

ख. शैक्षिक पाठ्यक्रममा राजनैतिक रूपले प्रेरित परिवर्तन छन्। इतिहासलाइ आफू खुसी पाठ्यपुस्तक बनाइएको पाइयो। 

१३. स्थानीय शासन व्यवस्था

क. शक्तिको केन्द्रीकरण, स्थानीय शासन सीमित छ। 

ख. स्थानीय निर्णय प्रक्रियामा पारदर्शिताको अभाव देखियो

ग. शक्तिको विकेन्द्रीकरण छैन

घ. बलियो स्थानीय शासन संरचना छैन र भएमा पनि केन्दिय सरकारले रोकेको अवस्था छ।  उदाहरणको लागि संघिय सरकार परिवर्तनसंगै प्रदेश सरकार फेरिनु। 

ङ. स्थानीय समुदायमा शक्ति हस्तान्तरण छैन। 

१४. नातावाद र कृपावाद

क. प्रमुख पदहरूमा परिवारका सदस्य वा नजिकका सहयोगीहरूको नियुक्ति, टिकेट दिने जस्ता लगायत सबैमा यस्तै पाइयो। 

ख. राजनीतिक सहयोगीहरूलाई स्रोतसाधनको अनुचित बाँडफाँड र दुरुपयोग भएको पाइयो। समानुपातिक सिटमा योग्यले हडप्नु गतिलो उदाहरण हो। 

१५. अन्तर्राष्ट्रिय सम्बन्ध

क. विवादास्पद विदेश नीति निर्णयहरू छन्। जसले लोकतान्त्रिक मूल्यहरूलाई कमजोर बनाएको छ।  

ख. अर्थतन्त्र वैदेशिक सहायतामा निर्भर छ। त्यसले नीतिको स्वतन्त्रतालाई असर गर्छ। 

१६. प्रहरी र सेनाको राजनैतिक दुरुपयोग

क. राजनैतिक उद्देश्यका लागि सुरक्षा बलको प्रयोग धेरै भएका छन्। यसबाट सुरक्ष क्षेत्रको मनोबल घट्ने र कामभन्दा चाप्लुसी गर्न बाध्य भएको पाइयो।

१७. सूचनामा पहुँच

क. सरकारी सूचनाको पहुँचमा प्रतिबन्ध या लुकाइएको पाइयो। 

ख. निर्णय प्रक्रियामा पारदर्शिताको अभाव छ। 

१८. निर्वाचन प्रणालीको अखण्डता

क. निर्वाचन आयोग स्वायत्त छैन। सरकारको नियन्त्रणमा छ। निर्वाचन प्रणालीका त्रुटिहरूलाइ ब्यबस्थापन गरिदैन। जसले निष्पक्षतालाई दबाएको पाइयो। बारंवार उस्तै घटना भएका र दोहोरिएका छन्।  

ख. निर्वाचन प्रक्रियामा, दलहरु प्रति नागरिकको विश्वास कमी हुँदै गएको छ। नयाँ र योग्य दल छान्ने कारण पनि यहि रहेछ।  

१९. नागरिक समाजको संलग्नता

क. गैरसरकारी संस्थाहरुको बेतुक अधिकार र नागरिक समाजको दमन बढेका छन्। 

ख. वकालत/अधिकार संबन्धि समूहहरूको गठन र सञ्चालनमा प्रतिबन्धहरू त होइन एक किसिमको रोकावटको लवी भएका छन्। युरोपियन युनियन, चीन तर्फकाले यसलाई अनाधिकृत रुपमा लगेका छन

२०. नैतिक आचरण

क. राजनैतिक नेताहरुको अनैतिक आचरण बढेको पाइयो।

ख. राजनीतिक दलभित्र हुने नैतिक उल्लङ्घनलाई सम्बोधन गर्न दलहरु असफल छन्। उनीहरु बचाउतिर केन्द्रिय छन्।

२१. संवैधानिक संशोधन

क. लोकतान्त्रिक सिद्धान्तलाई कमजोर बनाउने संविधानमा विवादास्पद संशोधनहरू भएका छन। हुनुपर्ने छुटेका छन्। 

ख. संशोधन प्रक्रियामा समावेशीताको अभाव, आफ्नालाइ गोदेर पराइलाइ मित्र बनाउने संसोधन छन्। 

२२. वातावरणीय नीतिहरू

क. वातावरणीय नीतिहरूमा लोकतान्त्रिक निर्णय प्रक्रियाको अभाव पाइयो।

ख. स्थानीय समुदायलाई असर गर्ने विभेदकारी नीतिहरू बनेका छन। 

२३. युवा संलग्नता

क. युवा राजनैतिक सहभागिताको अवसरको अभाव छ। उनीहरुलाइ दलहरुद्वारा राजनैतिक आवश्वासको लागि दुरुपयोग गरिएको छ। आसे-पासे बनाइएको छ। 

ख. दल-भित्र युवा मतदाताको मताधिकारबाट कम छ। उम्मेदवार हुने अवस्था काम छ। 

२४. राजनैतिक दलहरुमा आन्तरिक लोकतन्त्र

क. राजनैतिक दलभित्र लोकतान्त्रिक अभ्यासको अभाव छ। भनेका र गुटकाले जित्नु पर्ने या निर्वाचन नै नहुने गरिएको छ। 

ख. पार्टी नेतृत्वभित्र निर्णय गर्ने कार्यको केन्द्रीकरण छ। केवल एक व्यक्तिमा निहित छ। 

२५. सामाजिक न्याय

क. सामाजिक अन्यायलाई निरन्तरता दिने नीतिहरू छन। 

ख. ऐतिहासिक रुपमा असमानता टुङ्ग्याउन आर्थिक योजना ल्याइएको पाइएन।

यी र यस्ता सूचकहरूको मूल्याङ्कनले नेपालको लोकतन्त्रको अवस्थाको विस्तृत दृष्टिकोण प्रदान गर्न सक्छ। सुधार आवश्यक पर्ने क्षेत्रहरूमा प्रकाश पार्न सक्छ। यी सूचकहरूलाई सही रूपमा मूल्याङ्कन गर्न, गुणात्मक र मात्रात्मक डेटाको संयोजन प्रयोग गर्न आवश्यक देखियो। सबै रुपमा हेर्दा दलहरुले प्रजातन्त्र असफल बनाएका छन्।
